Two conservative groups, The Family Research Council and Concerned Women for America, have filed a lawsuit against the US Food and Drug Administration (FDA), asking the court to overturn FDA’s approval of the Plan B “morning after” pill for over-the-counter sale.

The groups said that FDA a) lacked the authority to approve distribution of the drug, and b) had never established the safety or effectiveness of the drug.

The American Association of Physicians and Surgeons and Safe Drugs for Women have joined the suit.

The Plan B pill has become particularly controversial lately because of several cases in which individual pharmacists at Wal-Mart and Kroger have refused to dispense the pill because they say it is tantamount to abortion. While the Plan B drug is OTC, FDA requires that pharmacists hand it out because girls under 18 are not allowed to have access to it.
