The Atlanta Journal-Constitution reports that a court battle is shaping up over the constitutionality of an ordinance that prohibits the operation of big box stores in the Peachtree City area.

The development of a Target store there has taken place because the big box store is owned by the retailer…and the ordinance says that it only applies to "tenants." Attorneys for target and the developers argue that since Target is not a tenant, the rules don't apply to it.

A local judge, however, disagreed, saying that the legislative intent was to cover owners as well.

The trial, which will judge the constitutionality of the ordinance, is slated to begin later this month.
